1. Scope of Application
These Terms and Conditions govern all purchases of original artworks, prints, digital files, and commissioned artworks made through this website or via direct communication with Veselka Bulkan.
By placing an order, the customer accepts these Terms and Conditions.
2. Art Sales
All artworks offered for sale are original creations by Veselka Bulkan unless otherwise stated.
Descriptions, images, and prices are provided with care but do not constitute a legally binding offer.
Colors, textures, and materials may vary slightly depending on the display device or lighting conditions.
Ownership of an artwork transfers to the customer after full payment has been received.
All copyrights remain with the artist, unless explicitly transferred in writing.
Commercial reproduction, digital use, or any modification of the purchased artwork is strictly prohibited without written permission from the artist.
3. Commissioned Artwork (Custom Work)
Commissioned artworks are created based on the customer’s individual preferences.
Process
Before work begins, the client receives a written confirmation including scope, materials, price, timeline, and artistic expectations.
A non-refundable deposit (usually 30–50%) may be required to secure the commission.
Work begins only after the deposit is received.
The completed artwork will be delivered after full payment is made.
Artistic Variability
Due to the creative nature of the process, minor artistic variations may occur. These do not constitute defects and are not grounds for complaint.
Copyright
All copyrights for commissioned artworks remain with the artist unless explicitly transferred in writing.
4. Prices and Payment
All prices are listed in EUR, including applicable taxes unless otherwise stated.
Shipping costs and special packaging costs may be charged separately.
Accepted payment methods include bank transfer, PayPal, or other methods agreed individually.
5. Shipping and Delivery
Artworks are shipped with appropriate protective packaging.
Risk of accidental loss transfers to the customer once the artwork is handed over to the shipping provider.
Wider international shipping times may vary.
Customers are responsible for customs duties and import taxes where applicable.
6. Returns and Cancellation (Widerrufsrecht)
6.1 Original Artwork Purchases (Non-Custom)
Customers may request a return within 14 days of receiving the artwork, provided:
The artwork is not custom-made
It is returned in its original condition
The customer covers return shipping and insurance
Refunds will be processed after the artwork is received in good condition.
6.2 Commissioned Artwork (Custom Work)
According to § 312g Abs. 2 Nr. 1 BGB (German law), custom-made or personalized artworks are excluded from the 14-day right of withdrawal.
Commissioned artworks cannot be returned or refunded.
6.3 Cancellation of Commissions
If a client cancels a commission before completion:
The deposit remains non-refundable
Additional compensation may apply depending on work already completed
7. Liability
The artist is liable for damages only in cases of intent or gross negligence.
No liability is assumed for slight deviations in color or material representation.
The website may contain links to third-party websites. The artist is not responsible for their content.
8. Copyright
All artworks, images, texts, and digital materials on this website are protected under German copyright law.
Any reproduction, editing, distribution, or commercial use without explicit written permission is prohibited.
9. Dispute Resolution
We are not willing or obligated to participate in dispute resolution proceedings before consumer arbitration boards under the German Consumer Dispute Resolution Act (VSBG).
However, we strive to resolve any disagreements directly and fairly.

10. Applicable Law
These Terms and Conditions are governed by German law.
Place of jurisdiction is Munich, Germany, unless mandatory consumer protection laws require otherwise.
11. Severability Clause
If any provision of these Terms is deemed invalid, the remaining provisions shall remain in full force and effect.
12. Workshops and Online Ticket Sales
12.1 Booking and Payment
Workshops offered on this website can be booked online.
A binding contract is formed once the customer completes the checkout process and receives a confirmation email.
Participation is only guaranteed after full payment of the workshop fee.
12.2 Ticket Policy
Workshop tickets are issued digitally and are valid only for the specific date and time indicated.
Tickets are non-transferable unless explicitly approved by the artist/organizer.
Reselling tickets commercially is not permitted.
12.3 Workshop Cancellations by the Customer
If the customer cancels their participation:
Up to 7 days before the workshop: 50% refund
Less than 7 days before the workshop: no refund
Since workshop spots are limited, late cancellations cannot be refunded.
No refund is provided for non-attendance (“no-show”).
12.4 Cancellations or Changes by the Organizer
If a workshop must be cancelled due to illness, insufficient participants, or unforeseen circumstances, customers will be offered:
A full refund or
A free transfer to another available workshop date
Further compensation (e.g., travel or accommodation costs) is excluded.
12.5 Workshop Conduct
Participants are required to follow all safety instructions and behave respectfully towards others.
The organizer reserves the right to remove participants who disrupt the workshop without refund.
12.6 Use of Media During Workshops
Photos or videos may be taken during workshops for documentation or promotional purposes.
If you do not wish to appear in such material, please inform us before the workshop starts.
